Hove and Associates Attorneys-at-law successfully represents Senior Superintendent of Police in landmark Wrongful and unfair dismissal Appeal Case

A senior municipal police officer in Trinidad and Tobago, Glen Charles, won an important appeal after challenging a court decision that awarded him only minimal compensation following the termination of his promotion. Charles, who served as a Municipal Police Superintendent at the Port-of-Spain City Corporation, had been appointed in 2017 to the role of Municipal Senior Superintendent within the Ministry of Rural Development and Local Government for a three-year term after obtaining no-pay leave from his previous position.

However, shortly after assuming office, issues emerged regarding documentation approving his leave, leading to the termination of his appointment and his return to his former role. Represented by Farai Hove-Masaisai of Hove and Associates, Charles pursued legal action. Although the High Court ruled in his favor, it awarded only $5,000 in nominal damages and denied exemplary damages.

Delivering judgment this week, Appellate Judge Geoffrey Henderson, alongside Justices Eleanor Donaldson-Honeywell and Joan Charles, ruled that the compensation awarded was inadequate and that the lower court failed to properly justify denying additional damages. The Court of Appeal ordered that Charles’ compensation be reassessed by a High Court Master at a later date.
